The My TrueEarnings Website is intended for viewing and participation in the United States only and is subject to the laws within the United States. The My TrueEarnings Website is sponsored by American Express Travel Related Services Company, Inc., 200 Vesey Street, New York, NY 10285 (the “Sponsor”).

Who is Eligible to Register and Participate: You must first register at The My TrueEarnings Website in order to participate. To be eligible to register in The My TrueEarnings Website you must be a legal resident of the 50 United States or the District of Columbia and at least 18 years of age and the holder in good standing of the TrueEarnings Card from Costco and American Express issued by American Express in the United States. This program is not open to individuals who have an American Express Card issued by a third party bank issuer.

How to register: To register, visit www.mytrueearnings.com (”The My TrueEarnings Website”) beginning on May 12, 2008 and complete the registration form: full name and email address. You must read and accept the Participation Agreement in order to submit your Rebate Redemption Story. The My TrueEarnings Website is available through 11:59 PM EST on October 31, 2008. This period may be extended at the discretion of the Sponsor.

Create

To Submit a Rebate Redemption Story: To submit a Rebate Redemption Story, go to www. mytrueearnings.com and submit Rebate Redemption Story during the submission period which commences at 12:00 AM EST on May 12, 2008 and ends at 11:59 PM EST on October 31, 2008 (“Submission Period”). Rebate Redemption Stories must be no more than 500 characters via text typed entry and submitted on the form found on The My TrueEarnings Website (“Rebate Redemption Story Submission”). To be eligible to submit a Rebate Redemption Story you must agree to the terms of The My TrueEarnings Participation Agreement. By submitting a Rebate Redemption Story you agree that Sponsor will own the Rebate Redemption Story Submission and will have the right to post the Rebate Redemption Story Submission along with your username, city (if provided), state (if provided) on The My TrueEarnings Website.

Requirements for Rebate Redemption Story Submissions: Rebate Redemption Story Submissions must meet the following requirements to be eligible:

It must be original and not copied from any other work. This means that the materials written for submission (and not necessarily the idea alone) must be the submitter’s original words and not copied from any copyrightable work.
It must be written in English (with the exception of single words or short terms from other languages which are permissible as long as their meaning is evident in the sole discretion of the Sponsor);
It cannot include any mention of any specific individual, company, organization, brands or products
It cannot contain any trademarks, tradenames, third party copyrighted material, or any material owned by any third party;
It cannot contain any personal identification of any kind, including names, street or e-mail addresses, or phone numbers.
It cannot contain any url addresses or website links;
It cannot be offensive, obscene, contain propaganda or potentially misleading information, or discriminate on the basis of race, religion, creed, national origin, disability, handicap, age, sexual orientation, marital status, veteran status or any other basis prohibited by law, as determined in the sole discretion of the Sponsor.
It cannot directly promote or speak negatively about any particular faith, political action, legislation or party or encourage the violation of any law, as determined in the sole discretion of the Sponsor;
It cannot relate to controversial subject matter or any subject which is contrary to the interests of American Express or its Cardmembers, as determined in the sole discretion of the Sponsor.
It cannot contain any photos

Cardmembers will be permitted a maximum of one Rebate Redemption Story Submission. Sponsor reserves the right, in Sponsor’s sole discretion, at any time and at any stage of the submission or posting process to reject or disqualify any Rebate Redemption Story Submission that is deemed ineligible or for any reason that Sponsor feels is necessary and/or appropriate in its sole discretion. The inclusion or posting of any Rebate Redemption Story on the My TrueEarnings Website is at the sole discretion of the Sponsor.

Ownership of Rebate Redemption Story Submissions: All Rebate Redemption Story Submissions become the property of the Sponsor and may be used by Sponsor, its parent and affiliated companies, and Digitas LLC and their respective agents, successors, and assigns and anyone authorized by them (“Sponsored Parties”), for any purpose and in any media whatsoever, whether or not now known, throughout the universe in perpetuity, without further compensation to the Cardmember who submitted it. By submitting a Rebate Redemption Story Submission, regardless of whether it is accepted or posted Cardmembers agree that they are assigning all right title and interest to the Rebate Redemption Story Submission to Sponsor, including without limitation all copyrights pertaining thereto. Sponsored Parties will be entitled to use the Rebate Redemption Story Submissions for any purpose whatsoever without compensation to Cardmembers who submitted the Rebate Redemption Story Submission or any other party. The assigned copyrights to the Rebate Redemption Story Submissions include, but are not limited to, the right to use, reproduce, modify, adapt, publish, create derivative works from, distribute and display the Rebate Redemption Story Submissions. The preceding rights may be exercised throughout the world in all media and formats whether now known or hereafter devised. The above rights also include the right to make such modifications as are necessary to exercise the rights granted.

Participant Representation: By submitting a Rebate Redemption Story, you represent and warrant that the Rebate Redemption Story Submission is original (not necessarily the idea but the materials you submit on The My TrueEarnings Website), has not been copied in whole or in part from any other work, does not violate or infringe any copyright, trademark, or other proprietary or privacy right of any person or entity, and agree to indemnify, defend and hold the Sponsored Parties harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representation. By participating in The My TrueEarnings Website and submitting a Rebate Redemption Story, you acknowledge compliance with and agree to be bound by The My TrueEarnings Website Terms and Conditions and the decisions of Sponsor and/or judges, which are final in all respects.

Conditions: Sponsored Parties are not responsible for (a) lost, late, unintelligible, misdirected, incomplete, damaged or garbled submissions or messages (b) telephone, computer, hardware, software, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process entries; (c) communication disruption or other forces beyond the reasonable control of the Sponsor, including inability to access The My TrueEarnings Website, create an online account, submit Rebate Redemption Story Submissions, utilize message boards, rate, vote; (d) any disruption related to Internet traffic, virus, bug, or nonauthorized intervention; (e) damage caused by computer virus or otherwise resulting to any computer from Cardmembers’ access to or participation with The My TrueEarnings Website, whether human, mechanical or electronic, or (f) incorrect or inaccurate information whether caused by Sponsor, The My TrueEarnings Website users or by any of the programming or equipment associated with or used in The My TrueEarnings Website. If such malfunction, error, disruption, or damage occurs, and/or impairs the administration, security, fairness, integrity, or proper execution of The My TrueEarnings Website and/or The My TrueEarnings Website is otherwise not capable of running as planned, Sponsor may, in its sole discretion, suspend The My TrueEarnings Website for the remainder of The My TrueEarnings Website Period or terminate any or all of The My TrueEarnings Website by posting a notice on www.mytrueearnings.com. Sponsor reserves the right, to disqualify the Rebate Redemption Story Submissions for any reason whatsoever, including any Rebate Redemption Story associated with any persons found tampering with or abusing any aspect of The My TrueEarnings Website, or any Cardmember who Sponsor believes to be causing malfunction, error, disruption, or damage and to maintain the Rebate Redemption Story submitted by that Cardmember or disqualify the Rebate Redemption Story associated with a Cardmember but disqualify that Cardmember who submitted the Rebate Redemption Story in its sole discretion. By participating in The My TrueEarnings Website you agree (i) that any and all disputes, claims, and causes of action arising out of or in connection with The My TrueEarnings Website must be brought in a court of competent jurisdiction within the United States and shall be resolved individually, without resort to any form of class action; (ii) to release and discharge the Sponsor and its administrators, legal representatives, officers, directors, employees, subsidiaries, affiliates, divisions, parents, predecessors, successors and assigns (the “Released Parties”) from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, direct or consequential damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties or any one or more of the Released Parties, which you ever had, now have or hereafter can, shall or may have which in any way arise out of or result from your participation in The My TrueEarnings Website

Use of Data: Sponsor will be collecting personal data about participants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at americanexpress.com. By participating in The My TrueEarnings Website, participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
